Design Registration - Governing Law

The Designs Act of 2000 established the framework for design registration and protection in India, replacing the previous 1911 Act. Following this, the Design Rules were introduced in 2001. Over the years, the Design Rules have been revised, with notable amendments occurring in 2008 and 2014 through the Designs (Amendment) Rules. A significant development in these updates is the inclusion of a new category of applicants. Now, alongside individual or natural persons, 'small entities' are recognized as distinct applicants under the Act.

Definition of a Design

According to Section 2(d) of the Designs Act 2001, a design is defined by its unique elements, which include the shape, pattern, configuration, composition, or decoration made up of lines or colours. This definition applies to any object, whether it’s two-dimensional, three-dimensional, or a combination of the two. The design can be realized through various industrial methods, using mechanical, manual, or chemical processes, either individually or together. Importantly, what distinguishes a design is its visual appeal in the final product, as assessed by the eye. It’s worth mentioning that the design does not take into account any underlying construction principles or anything that is simply a mechanical device.

Basic Requirements of Design Registration

To register and protect a design under the Design Act, 2000, several key criteria need to be fulfilled for successful Design e-filing:

• Innovation Element: Your design should have a fresh and unique characteristic. Only those designs that showcase this innovative quality are eligible for registration. Additionally, combinations of existing designs can be considered, but they must result in a distinctly appealing visual.
• Originality and Non-disclosure: Your design must be unique and should not have been disclosed publicly, whether in India or abroad. This means it must not have been published, used, or revealed in any form before. 
• Application to an Object: The design must be applicable to a specific product or object. Designs that exist independently, without relevance to an actual item, cannot be registered.
• Alignment with Public Values and National Security: The design should align with public morals, sentiments, and the security of India. Designs that are deemed inappropriate by the government or any authoritative body are ineligible for registration. It’s crucial that your design meets the criteria specified in section 5 of the Design Act, 2000. Make sure these criteria are met when you’re looking to submit a trademark for a design in accordance with the English language provisions of the Design Act, 2000.
• Exclusions from Design Registration: It’s important to note that certain exclusions apply to design registration, and not every design can be registered.

The following items are not eligible for Design e-filing registration:

• Literary or Artistic Works: Unlike copyright, design registration does not cover creative works like books, calendars, stamps, or tokens.
• Buildings and Structures: Architectural designs, including buildings and other structures, cannot be registered.
• Geographical Representations: Maps are not included in the design registration process.
• National Symbols: Designs that mimic or resemble national flags, emblems, or official symbols of any country are prohibited from registration.

 Who Can Apply for Design Registration Online?

The following individuals or entities are eligible to apply for Design Registration online:

• Applicants: Individuals, along with their legal representatives or assignees, can apply for design registration, either individually or as a group.
• Definition of Person: The term “person” applies to various entities, including firms, partnerships, small businesses, and corporations.
• Non-Resident Indians (NRIs): NRIs must have their applications for Design Registration filed through an agent or legal representative.

All provisions must be understood and followed as per the English language requirements for design registration.

Documents Required to Register a Design in India:

To register a design in India, applicants need to submit the following documentation:

• Applicant's Details: Full name and address of the applicant.
• Applicant's Nature/Status: Clearly indicate the legal status of the applicant (e.g., individual, company).
• Startup Certificate (if applicable) : Startups should provide their registration certificate.
• Description of the Article: A thorough description of the item relevant to the design, along with its classification according to the established categories.
• Visual Representation: Include a minimum of four images or drawings of the article, showcasing it from all angles with the application.
